Agreement to Terms

These Terms of Service constitute a legally binding agreement between you and TU ZAPATO S A S concerning your access to and use of our VPN service. By accessing or using the service, you agree that you have read, understood, and agree to be bound by all of these Terms of Service.

If you do not agree with all of these Terms of Service, then you are expressly prohibited from using the service and you must discontinue use immediately.

Acceptable Use

You agree to use our VPN service only for lawful purposes and in accordance with these Terms. You agree not to use the service:

• In any way that violates any applicable national or international law or regulation
• To transmit, or procure the sending of, any advertising or promotional material without our prior written consent
• To impersonate or attempt to impersonate the company, a company employee, another user, or any other person or entity
• In any way that infringes upon the rights of others, or in any way is illegal, threatening, fraudulent, or harmful
• To engage in any other conduct that restricts or inhibits anyone's use or enjoyment of the service
• To distribute malware, viruses, or any other harmful code
• To engage in unauthorized access to computer systems or networks

User Accounts

When you create an account with us, you must provide information that is accurate, complete, and current at all times. Failure to do so constitutes a breach of the Terms, which may result in immediate termination of your account.

You are responsible for safeguarding the password that you use to access the service and for any activities or actions under your password. You agree not to disclose your password to any third party. You must notify us immediately upon becoming aware of any breach of security or unauthorized use of your account.

Service Availability

We strive to provide reliable and continuous service, but we cannot guarantee that the service will be available at all times. The service may be subject to limitations, delays, and other problems inherent in the use of the internet and electronic communications.

We reserve the right to modify, suspend, or discontinue the service (or any part thereof) at any time, with or without notice. We will not be liable to you or to any third party for any modification, suspension, or discontinuance of the service.

Subscription and Payment

Access to certain features of the service may require payment of fees. You agree to pay all fees associated with your subscription plan. All fees are non-refundable unless otherwise stated in our refund policy.

We reserve the right to change our subscription fees at any time. Any fee changes will be communicated to you in advance and will take effect at the start of your next billing cycle.

Intellectual Property Rights

The service and its entire contents, features, and functionality (including but not limited to all information, software, text, displays, images, video, and audio) are owned by TU ZAPATO S A S, its licensors, or other providers of such material and are protected by copyright, trademark, patent, trade secret, and other intellectual property laws.

You may not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any of the material on our service without our prior written consent.

Limitation of Liability

To the fullest extent permitted by applicable law, in no event will TU ZAPATO S A S, its affiliates, officers, directors, employees, agents, suppliers, or licensors be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from:

• Your access to or use of or inability to access or use the service
• Any conduct or content of any third party on the service
• Any content obtained from the service
• Unauthorized access, use, or alteration of your transmissions or content

Indemnification

You agree to defend, indemnify, and hold harmless TU ZAPATO S A S and its licensors, licensees, and service providers from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms of Service or your use of the service.

Termination

We may terminate or suspend your account and bar access to the service immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever, including without limitation if you breach the Terms of Service.

Upon termination, your right to use the service will immediately cease. If you wish to terminate your account, you may simply discontinue using the service or contact us to request account deletion.

Governing Law

These Terms shall be governed and construed in accordance with the laws of Colombia, without regard to its conflict of law provisions. Any disputes arising from these Terms or your use of the service shall be subject to the exclusive jurisdiction of the courts located in Barranquilla, Colombia.

Changes to Terms

We reserve the right to modify or replace these Terms at any time at our sole discretion. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

By continuing to access or use our service after any revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, you are no longer authorized to use the service.
